The head of the Court of Instruction number 7 of Seville has rejected the lawsuit filed by the parents of Sandra Peña, the 14-year-old girl who committed suicide, against the Irish Sisters of Loreto private school. In his ruling, the judge maintains that the school and its administrators "took measures to combat the bullying," but that they were not required to "control the minor at all times to prevent her from taking her own life," considering that Sandra committed suicide at home and outside of school hours.
According to the judge, "the bullying protocol is undoubtedly effective, but this does not mean that, had it been adopted, it would have hindered the minor's will to make the decision she made."
The Public Prosecutor's Office for Minors indicates that the school became aware of a possible bullying situation on September 1, 2025, when Sandra's mother gave the school administration a report issued by the psychologist who had treated her during the summer. The report "included the minor's statements regarding teasing and derogatory comments from a group of classmates and self-harm" by the girl, who was suffering from "an anxious-depressive psychological condition that was significantly affecting her quality of life."
"The judge presiding over the lawsuit filed by Sandra Peña's parents against the Irish School of Loreto has decided to dismiss the case, and the death of the 14-year-old girl, which occurred on October 14, 2025, will go unpunished. The parents, and indeed the entire city of Seville, because the situation was common knowledge, accused the school where the teenager studied of failing to activate the anti-bullying protocol, despite having informed the administration that their daughter was being bullied by three classmates. They had even submitted a psychological report on Sandra, paid for by the girl's parents, which documented a situation of anxiety and depression with self-harm. Self-harm is a warning sign that, in general, adolescents exhibit before suicide. However, the judge followed the recommendation of the Juvenile Prosecutor's Office; both requested the dismissal of the case against the Irish School of Loreto. El titular del Juzgado de Instrucción número 7 de Sevilla ha rechazado la Querella interpuesta por los padres de Sandra Peña, la niña de 14 años que se suicidó, contra el colegio concertado Irlandesas de Loreto.
En su fallo, el juez sostiene que el colegio y sus responsables "adoptaron medidas para combatir la situación de acoso", pero que no les era exigible que “controlaran a la menor en todo momento para evitar que esta se quitara la vida”, tomando en cuenta que Sandrita se suicidó en su domicilio y fuera del horario escolar.
Para el juez; "el protocolo de acoso es indudablemente eficaz, pero ello no quiere decir que, de haberse adoptado, se hubiera obstaculizado la voluntad de la menor de tomar la decisión que tomó".
El Ministerio Público de Menores señala que el colegio tuvo conocimiento de una posible situación de acoso escolar el 1 de septiembre de 2025, cuando la madre de Sandra entregó al equipo directivo un informe emitido por la psicóloga que la había atendido durante el verano y en el que “se recogían las manifestaciones de la menor sobre burlas y comentarios despectivos por parte de un grupo de compañeras de clase y autolesiones” que se hacía la niña, que sufría "un cuadro psicológico ansioso-depresivo que estaba afectando de manera significativa a su calidad de vida".
"El juez que instruía la Querella de los padres de Sandra Peña contra el colegio Irlandesas de Loreto ha decidido archivar la causa y la muerte de la joven de 14 años, ocurrida el 14 de octubre de 2025 quedará impune. Los padres y toda Sevilla, porque la situación era vox populi, acusaban al centro en el que estudiaba la adolescente de no haber activado el protocolo antiacoso, pese a que habían comunicado a la dirección que su hija sufría bullying por parte de tres compañeras del centro. Habían agregado el informe psicológico sobre Sandra, pagado de los bolsillos de los papás de la niña; que daban cuenta de una situación de ansiedad y depresión con autolesiones. Las autolesiones, son el semáforo amarillo que en general, prenden los adolescente antes del suicidio. Sin embargo, el magistrado ha seguido el criterio de la Fiscalía de Menores; ambos pidieron el Sobreseimiento del Instituto Irlandesas de Loreto. Bullying Sin Fronteras sabe de tragedias, de injusticias y de impunidad. Por eso existe; para denunciarlas. Lo lamento mucho, papás de Sandra. Lo lamento mucho, Sevilla. No habrá justicia para Sandra Peña"; dijo el Dr. Javier Miglino Helfenstein, Experto en Derechos Humanos y Protección de la Niñez y Director Mundial de Bullying Sin Fronteras.
