Lindsay Clancy trial declared mistrial after seven days of deliberations without unanimous verdict

The trial of nurse Lindsay Clancy was officially declared a mistrial after the jury failed to reach a unanimous verdict following seven days of deliberations in a case in which the defendant faces charges over the deaths of her three children.
Judge William Sullivan declared the mistrial after the 12-member jury was unable to agree on a verdict.
Defense attorney Kevin Reddington filed an emergency appeal seeking to prevent the mistrial.
“In the United States, declaring a mistrial because jurors are unable to agree on a verdict does not have the same consequences as it does under codified legal systems such as those in Western Europe, except the United Kingdom, Latin America, Asia and Africa,” said Dr. Javier Miglino Helfenstein, an international lawyer specializing in Human Rights and Child Protection.
“Under codified law, a judge’s declaration of a mistrial definitively ends the trial and the charges and accusations are immediately withdrawn. They are equivalent to an acquittal,” he added.
In the United States, however, prosecutors can seek a new trial with another jury, pursue a plea agreement or withdraw the charges.
Clancy’s defense attorney, who represented her after she was charged with the aggravated killing of her three children, including first-degree murder charges, is seeking to avoid the strain of a new proceeding and have his client released, according to Miglino Helfenstein.
According to reports attributed to the prosecution, if the mistrial stands, prosecutors could seek a new trial on a lesser charge: second-degree murder.
“This type of charge allows the defendant to be tried solely by a judge rather than a jury and facilitates plea agreements,” Miglino Helfenstein said.
The lawyer added that Reddington’s appeal was rejected, meaning the murder trial of Lindsay Clancy officially concludes with a mistrial.

El defensor de Clancy, quien llegó al juicio acusada del triple crimen agravado de sus propios hijos por homicidio en primer grado, busca evitar el desgaste de un nuevo proceso y lograr que su defendida quede en libertad, según Miglino Helfenstein.
De acuerdo con versiones atribuidas a la Fiscalía, si la nulidad se mantiene, los fiscales podrían solicitar un nuevo juicio por un cargo menor: homicidio en segundo grado.
“Este tipo de acusación permite a la acusada que no haya un jurado sino que sea juzgada solo por un juez y facilita los acuerdos de culpabilidad”, afirmó Miglino Helfenstein.
El abogado agregó que la apelación presentada por Reddington fue rechazada, por lo que el juicio por asesinato contra Lindsay Clancy concluye oficialmente con una declaración de nulidad.

一方、米国では、検察側が別の陪審員による再審を求めたり、有罪答弁による司法取引を進めたり、起訴を取り下げたりすることが可能です。
ミグリノ・ヘルフェンシュタイン氏によると、クランシー被告の弁護人は、3人の実子の加重殺人、第一級殺人の罪で起訴された被告について、再審による負担を避け、依頼人を釈放させることを目指している。
検察側からの情報によると、審理無効が維持された場合、検察は今回より軽い罪である第二級殺人での再審を求める可能性がある。
「この種の起訴では、陪審員ではなく裁判官だけによる審理が可能となり、有罪答弁による司法取引も容易になります」とミグリノ・ヘルフェンシュタイン氏は述べた。
